We operate under strict food safety and service guidelines to ensure every order meets our high standards. By purchasing from us, you agree to comply with all applicable laws and these Terms.
We reserve the right to update, change, or replace any part of these Terms at any time by posting updates to our website. It is your responsibility to check this page periodically for changes. Your continued use of our website or services following the posting of changes constitutes acceptance of those changes.
2. Right to Refuse Service
We value all our customers and strive to provide exceptional service. However, we reserve the right to refuse service to anyone, at any time, for any reason that is legally permissible. Examples include but are not limited to:
- Suspected fraudulent transactions or unauthorized use of credit cards.
- Abuse, threats, or inappropriate behavior toward our employees.
- Attempts to manipulate promotions, discounts, or digital systems.
- Orders that appear to involve digital shoplifting, chargeback abuse, or unusual purchasing patterns.
- Circumstances where fulfilling the order would compromise product quality, violate food safety regulations, or create an unreasonable risk.
If your order is refused or canceled, we will notify you as soon as possible. Where applicable, a refund will be processed to the original payment method in a timely manner.

All prices listed on our website are in U.S. dollars and are subject to change without notice. Payment is required in full at the time of placing your order.

Item pricing may vary between our website, our factory retail shop, and other in-store locations. We reserve the right to set different prices in different sales channels, and prices may not always match.
If you make a purchase online and discover a different price in-store, we are not obligated to refund the difference or adjust the price. While you are welcome to inquire in person, any adjustments made in-store are at the discretion of the store manager.
Our factory retail shop may also feature exclusive promotions, sales, or limited-time offerings that are not available on our website, and vice versa. These variations are a normal part of our business and are designed to create unique experiences for both our online and in-store customers.
4. Shipping Policy
4.1 Carrier Responsibility
Once your order has left our facility, it is placed in the care of the shipping carrier (e.g., UPS, FedEx, USPS). We are not responsible for damage, delays, or mishandling that occurs while the package is in the possession of the carrier.
If your package is delayed, lost, or arrives damaged due to carrier mishandling, we will assist you in opening a claim with the carrier, but the ultimate liability rests with the carrier.
4.2 Packaging and Warm Weather Shipping
We take extraordinary care in packaging your order. During warmer months, insulated liners, gel packs, or expedited shipping options may be used to reduce the risk of melting. However, chocolate and confections are temperature-sensitive, and we cannot guarantee that heat-related damage will not occur once the package is in transit.
4.3 Customer Responsibility
It is the customer’s responsibility to:
- Provide an accurate and complete shipping address at the time of purchase.
- Ensure that someone is available to receive the order during the expected delivery window.
- Retrieve and properly store your package promptly after delivery to preserve product quality.
Once a shipping carrier provides proof of delivery (such as GPS confirmation, driver scan, or tracking number marked as “delivered”), our obligation has been fulfilled. Jean-Marie Auboine Chocolatier is not responsible for packages that are lost, stolen, or damaged after a carrier has confirmed delivery.
If a package is stolen after delivery, we are unable to offer a replacement or refund. Similarly, if a package is left unattended (for example, at a doorstep, lobby, or mailbox) and the products melt, spoil, or are otherwise damaged, we cannot be held liable.
To ensure safe delivery of your chocolate gifts:
- Please choose a shipping address where someone is available to receive the order during business hours (such as a workplace, reception desk, or staffed location).
- Promptly bring your order indoors upon delivery to prevent exposure to weather, heat, or theft.
Packages delivered within the respected carrier time frame and confirmed as delivered are considered completed orders. No replacements or refunds will be provided for packages stolen or left to melt after delivery.
5. In-Store Experience (Pick-Up Orders)
5.1 Order Preparation Time
- After placing your order, you will receive an email confirmation when your order is ready for pickup.
- Some items require several hours or up to 72 hours of advance preparation.
- For rush orders, please call us directly during normal business hours (Monday–Friday, 9 AM – 5 PM PST) to discuss special requests. We are not open on weekends.
5.2 ID and Credit Card Verification
To protect our customers from theft and unauthorized pickups:
- You must present a valid government-issued photo ID.
- You must also present the credit card used for the purchase.
This policy ensures your order is released only to the rightful purchaser and reduces the risk of fraud or stolen merchandise.
6. Refund & Replacement Policy
6.1 All Sales Final
Because we sell perishable food products, all sales are final. We do not offer refunds, returns, or exchanges under any circumstances. Food cannot be resold once it leaves our facility, and any returned items must be discarded for safety reasons.
6.2 Damaged, Defective, or Melted Products
If your order arrives damaged, destroyed, or melted, you must notify us within 24 business hours of receipt. Please include photos of the product and packaging when possible. We will review the situation promptly and provide a fair solution, which may include a replacement or credit.
7. Fraud Prevention and Order Cancellations
7.1 Digital Shoplifting & Fraud
E-commerce fraud, chargeback abuse, and digital shoplifting are increasing concerns for online businesses. We take these matters seriously and employ systems to detect suspicious activity.
We reserve the right to:
- Cancel any order we suspect to be fraudulent.
- Verify billing information and request additional proof of identity.
- Refuse future service to individuals or accounts associated with confirmed fraud.
7.2 Order Cancellations by Us
Orders may be canceled by Jean-Marie Auboine Chocolatier for reasons including but not limited to:
- Inaccurate or unverifiable billing or shipping information.
- Suspected fraud or unauthorized use of a payment method.
- Inventory shortages or unavailability of the product ordered.
- Operational issues that prevent fulfillment without compromising quality.
If we cancel an order, we will notify you by email and issue a prompt refund where applicable.
7.3 Order Cancellations by Customer
Because our products are perishable, customer-initiated cancellations are not permitted once production has begun. Please contact us as soon as possible if you wish to cancel; we will accommodate only if your order has not entered preparation.
8. Customer Conduct and Responsibilities
You agree not to use our website or services for any unlawful purpose. You also agree not to interfere with or disrupt the security or performance of our website. Abusive language, harassment, or threats directed at our employees or representatives will not be tolerated and may result in refusal of service.
9. Product Availability, Substitutions, and Shelf Life
We make every effort to maintain accurate product listings, but availability may vary due to seasonal ingredients or high demand. We reserve the right to substitute items of equal or greater value when necessary. If a substitution is significant, we will attempt to contact you prior to shipping or pickup.
Shelf Life: Shelf life varies by product. Each item is labeled with a clearly marked “Best By” date. Products should be consumed within 30 days from that date for best quality. Jean-Marie Auboine Chocolatier is not responsible for product quality if items are consumed past their labeled shelf life.
10. Allergens and Food Safety
Our products are manufactured in a facility that processes peanuts, tree nuts, milk, wheat, soy, eggs, and sesame. Depending on the item selected, our products may contain one or more of these allergens, may contain all of these allergens, and/or may contain traces of these allergens.
We are GMP certified, and food safety, quality, and compliance are taken very seriously in our manufacturing facility. Every team member is responsible for upholding these standards.
Important Notice: Allergens can cause severe or even life-threatening reactions. If you have a known allergy to any of the above ingredients, we strongly advise that you do not consume our products. By purchasing and consuming our products, you acknowledge and accept the risks associated with potential allergen exposure, and Jean-Marie Auboine Chocolatier cannot be held responsible for any allergic reactions that may occur.
11. Intellectual Property
All content on our website, including text, graphics, logos, product names, packaging designs, photographs, and digital content, is the property of Jean-Marie Auboine Chocolatier and is protected by copyright, trademark, and other intellectual property laws.
